Terms of Service

By creating an account or using SwissGuard VPN ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("the User") and ESCAPE PLAN DEVELOPMENTS FZCO (Trade No: 75936), operating as SwissGuard VPN ("SwissGuard VPN," "we," "us," or "our"), a company registered in the United Arab Emirates.

You must be at least 18 years of age to use this Service. By using the Service, you represent that you are at least 18 years old.

SwissGuard VPN provides a virtual private network (VPN) service that encrypts your internet connection and routes it through our secure servers worldwide. Our service includes:

• Encrypted VPN connections using the WireGuard protocol.
• Access to our global network of servers across 50+ countries.
• Native applications for Windows, macOS, iOS, Android, and Linux.
• Built-in ad and malware blocking at the DNS level.
• Kill switch functionality to prevent data leaks.
• Customer support via email and live chat.

All VPN traffic is routed through our secure server infrastructure in Switzerland, benefiting from Swiss privacy protections. This Swiss routing is a core feature of our service.

The specific features available to you depend on the subscription plan you choose. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To use SwissGuard VPN, you must create an account by providing a valid email address and creating a password. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.
• Providing accurate and complete registration information.

You may not share your account with individuals outside your subscription plan's device limits. We reserve the right to suspend or terminate accounts that violate these Terms.

SwissGuard VPN is designed to protect your privacy and security. However, the Service may not be used for any illegal or unauthorized purpose. You agree not to use the Service to:

• Engage in any activity that violates applicable local, state, national, or international laws or regulations.
• Transmit any material that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Distribute malware, viruses, or any other malicious software.
• Engage in activities that abuse, interfere with, or disrupt the Service or servers and networks connected to the Service.
• Send unsolicited bulk messages (spam) or engage in phishing activities.
• Attempt to gain unauthorized access to other computer systems or networks.
• Infringe upon the intellectual property rights of others.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund. While we do not monitor user activity (in accordance with our zero-log policy), we may take action based on complaints received from third parties or legal authorities.

SwissGuard VPN operates on a subscription basis. By subscribing, you agree to the following payment terms:

• Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected.
• All prices are listed in US Dollars (USD) unless otherwise stated.
• Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
• You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.

We accept major credit cards, PayPal, and select cryptocurrency payments. All payment processing is handled by trusted third-party providers.

We offer a 30-day money-back guarantee on all subscription plans. If you are not satisfied with our Service for any reason, you may request a full refund within 30 days of your initial purchase.

• Refund requests must be submitted within 30 days of the original purchase date.
• Refunds are processed to the original payment method within 5–10 business days.
• The 30-day guarantee applies to first-time purchases only. Renewal payments are eligible for refunds on a case-by-case basis.
• Accounts terminated due to violations of the Acceptable Use Policy are not eligible for refunds.

All content, features, and functionality of SwissGuard VPN, including but not limited to the software, design, text, graphics, logos, and trademarks, are the exclusive property of ESCAPE PLAN DEVELOPMENTS FZCO and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the SwissGuard VPN applications solely for your personal, non-commercial use in connection with an active subscription. You may not:

• Copy, modify, or distribute our software or any portion thereof.
• Reverse engineer, decompile, or disassemble our applications.
• Use our trademarks or branding without prior written consent.
• Resell, sublicense, or commercially exploit our Service.

To the fullest extent permitted by applicable law, SwissGuard VPN AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount paid by you to SwissGuard VPN during the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure at all times, although we strive to maintain the highest possible standards of reliability and security.

Either party may terminate this agreement at any time:

• By you: You may cancel your subscription and delete your account at any time through your account dashboard or by contacting support.
• By us: We may suspend or terminate your account if you violate these Terms, engage in activities prohibited by our Acceptable Use Policy, or fail to pay subscription fees.

Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination will continue to apply, including but not limited to limitations of liability, intellectual property provisions, and dispute resolution.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify you via email at least 30 days before significant changes take effect.
• Provide a summary of the changes made.

Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your subscription.
