Please read these Terms of Service carefully before using SwissGuard. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account or using SwissGuard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you ("the User") and ESCAPE PLAN DEVELOPMENTS FZCO (Trade No: 75936), operating as SwissGuard ("SwissGuard," "we," "us," or "our"), a company registered in the United Arab Emirates.
You must be at least 18 years of age to use this Service. By using the Service, you represent that you are at least 18 years old.
2. Service Description
SwissGuard provides a private security and encryption service that encrypts your internet connection and routes it through our secure servers. Our service includes:
- Encrypted connections using the WireGuard protocol.
- Access to our growing network of servers across multiple countries. The number of available server locations may vary and is subject to change.
- Client applications for supported platforms. Platform availability may vary; check our download page for currently supported platforms.
- DNS-level ad and malware blocking (where available).
- Kill switch functionality to prevent data leaks.
- Customer support via email.
Traffic is routed through our secure server infrastructure, including servers located in Switzerland, benefiting from Swiss privacy protections. Server routing may vary based on your selected server location.
The specific features available to you depend on the subscription plan you choose. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. The Service is a privacy tool and is not designed or intended to be used for any unlawful purpose.
3. Account Registration
To use SwissGuard, you must create an account by providing a valid email address and creating a password. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use of your account.
- Providing accurate and complete registration information.
You may not share your account with individuals outside your subscription plan's device limits. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use Policy
SwissGuard is designed to protect your privacy and security online. The Service is a legitimate privacy tool and must not be used for any illegal, harmful, or unauthorized purpose. You expressly agree that you will not use the Service to:
- Engage in any activity that violates applicable local, state, national, or international laws or regulations, including but not limited to laws governing data privacy, export control, consumer protection, and unfair competition.
- Access, transmit, distribute, or store any material related to child sexual abuse material (CSAM) or the exploitation of minors in any form. We maintain a zero-tolerance policy and will cooperate fully with law enforcement regarding such activity.
- Facilitate, promote, or engage in terrorism, violent extremism, or the incitement of violence against any individual, group, or government.
- Engage in, facilitate, or support human trafficking, forced labour, or modern slavery.
- Conduct or facilitate illegal drug trafficking or the sale of controlled substances.
- Transmit any material that is threatening, abusive, harassing, defamatory, libellous, or constitutes stalking, doxxing, or harassment of any individual.
- Distribute malware, viruses, ransomware, trojans, worms, or any other malicious software or code.
- Launch or participate in denial-of-service (DoS/DDoS) attacks, port scanning, network probing, or any form of cyberattack against any system or network.
- Engage in activities that abuse, interfere with, or disrupt the Service, our infrastructure, or any servers and networks connected to the Service.
- Send unsolicited bulk messages (spam), conduct phishing attacks, or engage in social engineering schemes.
- Attempt to gain unauthorized access to other computer systems, networks, or accounts (hacking).
- Infringe upon the intellectual property rights of others, including copyright, trademark, or patent rights.
- Engage in fraud, identity theft, financial crimes, or money laundering.
- Resell, sublicense, or redistribute the Service or secure connection to third parties without written consent.
- Use the Service to circumvent legal obligations, evade law enforcement, or obstruct justice in any jurisdiction.
Enforcement. Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund or prior notice. While we operate under a strict zero-log policy and do not monitor user activity, we may take action based on: (a) complaints or abuse reports received from third parties; (b) valid legal orders from competent authorities in the UAE or Switzerland; (c) detection of network abuse patterns that threaten the integrity of our infrastructure; or (d) information provided to us by law enforcement agencies in connection with a lawful investigation.
User Responsibility. You are solely responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction. Private network usage may be restricted or regulated in certain countries. It is your responsibility to determine whether using this service is lawful in your location. SwissGuard makes no representation that the Service is appropriate or available for use in all jurisdictions.
5. Payment Terms
SwissGuard operates on a subscription basis. By subscribing, you agree to the following payment terms:
- Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected.
- All prices are listed in US Dollars (USD) unless otherwise stated.
- Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
- You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.
We accept major credit and debit cards and select cryptocurrency payments. All payment processing is handled by trusted third-party providers. Accepted payment methods may vary by region and are subject to change. We are not responsible for any fees charged by your bank, card issuer, or payment provider in connection with your payment.
6. Refund Policy
We offer a 30-day money-back guarantee on all subscription plans. If you are not satisfied with our Service for any reason, you may request a full refund within 30 days of your initial purchase.
- Refund requests must be submitted within 30 days of the original purchase date.
- Refunds are processed to the original payment method within 5–10 business days.
- The 30-day guarantee applies to first-time purchases only. Renewal payments are eligible for refunds on a case-by-case basis.
- Accounts terminated due to violations of the Acceptable Use Policy are not eligible for refunds.
Payments made via cryptocurrency are non-refundable due to the nature of blockchain transactions. We may, at our sole discretion, offer account credit in lieu of a cash refund for cryptocurrency payments.
If you initiate a chargeback or payment dispute with your bank or card issuer without first contacting us, your account may be immediately suspended pending resolution of the dispute.

7. Intellectual Property
All content, features, and functionality of SwissGuard, including but not limited to the software, design, text, graphics, logos, and trademarks, are the exclusive property of ESCAPE PLAN DEVELOPMENTS FZCO and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the SwissGuard applications solely for your personal, non-commercial use in connection with an active subscription. You may not:
- Copy, modify, or distribute our software or any portion thereof.
- Reverse engineer, decompile, or disassemble our applications.
- Use our trademarks or branding without prior written consent.
- Resell, sublicense, or commercially exploit our Service.
8. Limitation of Liability
To the fullest extent permitted by applicable law, ESCAPE PLAN DEVELOPMENTS FZCO (operating as SwissGuard) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, business opportunity, or revenue, arising out of or related to your use of or inability to use the Service.
Our total aggregate liability for any and all claims arising under these Terms shall not exceed the amount paid by you to SwissGuard during the twelve (12) months immediately preceding the event giving rise to the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The Service will be uninterrupted, error-free, or completely secure at all times.
- The Service will meet your specific requirements or expectations.
- The Service will provide absolute anonymity or make you untraceable under all circumstances.
- The Service will be able to bypass all geographic content restrictions, as third-party services may detect and block secure connections.
- Connection speeds will equal your normal internet speed, as encryption and routing may affect performance.
You acknowledge that no privacy service can guarantee complete anonymity or security. SwissGuard is not responsible for any actions you take while connected to the Service, including any consequences arising from your violation of any applicable law.
9. Termination
Either party may terminate this agreement at any time:
- By you: You may cancel your subscription and delete your account at any time through your account dashboard or by contacting support.
- By us: We may suspend or terminate your account if you violate these Terms, engage in activities prohibited by our Acceptable Use Policy, or fail to pay subscription fees.
Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination will continue to apply, including but not limited to limitations of liability, intellectual property provisions, and dispute resolution.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
11. Indemnification
You agree to indemnify, defend, and hold harmless ESCAPE PLAN DEVELOPMENTS FZCO, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service, including any activity conducted through your account.
- Your violation of these Terms or the Acceptable Use Policy.
- Your violation of any applicable law, regulation, or third-party right.
- Any content you transmit through the Service.
- Any claim by a third party arising from your use of the Service.
This indemnification obligation shall survive termination of your account and these Terms.
12. No Guarantee of Anonymity
While SwissGuard employs industry-leading encryption and operates under a strict zero-log policy, we do not and cannot guarantee absolute anonymity, untraceability, or immunity from legal process. You acknowledge that:
- No technology can guarantee complete anonymity on the internet.
- User behaviour, browser fingerprinting, account information, and other factors outside the secure connection may compromise anonymity.
- We may be required to comply with valid legal orders from courts of competent jurisdiction in the UAE or Switzerland, though our zero-log infrastructure limits the data we are able to provide.
- The Service is not intended to facilitate or enable illegal activity and should not be relied upon for that purpose.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Last updated" date at the top of this page.
- Notify you via email at least 30 days before significant changes take effect.
- Provide a summary of the changes made.
Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your subscription.
14. Severability & Miscellaneous
Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SwissGuard regarding the Service and supersede all prior agreements, representations, and understandings.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of ESCAPE PLAN DEVELOPMENTS FZCO.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure. SwissGuard shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, cyberattacks, government actions, power failures, internet disruptions, or pandemics.
